IPTAB Trials
Overview
BAE, KIM & LEE IP effectively represents clients for proceeding trials before the Korean Intellectual Property Trial and Appeal Board (“IPTAB”) in the process of and/or after a registration of various IP rights. Frequently filed and disputed trials before the IPTAB are appeals against the Korean Intellectual Property Office (“KIPO”)’s final rejection, invalidation trials and trials for confirming the scope of rights.
An appeal against the KIPO’s final rejection is a trial to dispute the KIPO’s final rejections of applications for patents/utility models/trademarks/designs. Applicants may have an opportunity to actively dispute the KIPO examiners’ rejection grounds and eventually register their desired patents/utility models/trademarks/designs.
An invalidation trial is filed to nullify a patent/utility model/trademark/design registration when the registration has been issued against the relevant laws. This can be effective when a party defends itself more actively from other’s intellectual property right infringement claim through nullifying the registration based on which the infringement is claimed.
Trials for confirming the scope of rights are sought when an owner of an IP right or an interested party wishes to confirm the scope of protection of a patent/utility model/trademark/design registration. The IPTAB’s judgment on the scope of IP right might be used as a crucial evidence for determining infringement in the various IP infringement-related lawsuits.
