Overview

Hyobong Kim is well-versed in both regulations and market practice in digital finance and virtual assets with expertise and knowhow based on her experience of working for the Financial Supervisory Service for over a decade.

Having graduated from the Judicial Research and Training Institute, Ms. Kim dealt with the improvement of fund and trust systems, mediation of disputes over private equity funds, and digital finance cases at the Financial Supervisory Service. Since 2022, she has focused on supporting the establishment of virtual asset regulations, such as the enactment of the Act on the Protection of Virtual Asset Users and its subordinate statutes and the establishment of self-regulations on the listing of virtual asset on domestic crypto platforms.

Ms. Kim earned her LL.B. from Yonsei University and graduated from the Judicial Research and Training Institute. She earned her LL.M. from Columbia Law School and completed the professional M.B.A. program at Sungkyunkwan University. She has deep understanding and balanced perspective in domestic and international laws as well as corporate management and financial market practices.

Representative Matters

Provided legislative consulting services for the bill on the innovation and growth of the digital asset market, introduced by Kang-il Lee, Member of the National Assembly (Democratic Party of Korea)
Advised VASPs on new filings, renewal filings and change filings
Advised a virtual asset exchange on changing banks for real-name verified deposit and withdrawal accounts
Assisted an overseas virtual asset operator in entering the Korean market and acted as counsel in filing its VASP (Virtual Asset Service Provider) registration application
Responded to domestic sanctions imposed on an unregistered overseas virtual asset service provider
Responded to inspections and sanctions by financial authorities on virtual asset service providers and financial institutions (including matters relating to virtual assets, AML, and the Foreign Exchange Transactions Act)
Responded to investigations into unfair trade practices involving virtual assets
Advised the Digital Asset Protection Foundation on its establishment and operation
Reviewed numerous matters regarding the legal nature of tokens and NFTs
Conducted numerous legal reviews and provided legal advice on digital assets, including stablecoin and other virtual asset payment services and development of tokenized financial investment products
