John P. Bang is co-head of the International Arbitration & Litigation Practice Group at Bae, Kim & Lee LLC. John, together with Kevin Kim, leads a team of over 30 attorneys specializing in international arbitration and cross-border disputes. John has represented parties in well over 200 international arbitral proceedings, covering all the major international arbitration rules and institutions, and seated in jurisdictions across Asia, Europe and North America. He has also served on a number of arbitral tribunals both as a party-appointed arbitrator and as chairman or sole arbitrator. He is listed as a “Band 1” practitioner in Chambers Asia and is consistently listed in Who’s Who Legal (2007-2019) and Asialaw Leading Lawyers (2008-2019). John was awarded the “Disputes Star of the Year” at the Asialaw Asia-Pacific Dispute Resolution Awards 2016. In 2011, John was included in GAR’s exclusive “45 under 45” list as one of only 5 individuals included from Asia. He is a Court member of the Singapore International Arbitration Centre (SIAC) and an officer in the IBA Litigation Committee.

  • Acts as counsel to the Republic of Korea in an ICSID arbitration based on the Korea-Belgium/Luxembourg BIT, involving multi-billion dollar claims
    Co-arbitrator in a SIAC arbitration seated in Singapore, arising out of an insurance claim under a trade credit insurance policy for the sale of steel. The governing law of the insurance contract is Singapore law. The other two members of the tribunal are a Senior Counsel from Singapore and a Queen’s Counsel from London, England.
    Acts as counsel to a major Korean utilities company in a very high-value LCIA-arbitration arising from a dispute regarding the procurement, construction and commissioning of the first nuclear power station in the United Arab Emirates.
    Acts as counsel in an ICC arbitration seated in Korea, arising from a large real estate development project in Korea, and involving issues related to the financing of the project.
    Acts as counsel in an ICC-arbitration arising from a dispute regarding the alleged unauthorized use of high-value proprietary enterprise resource planning software in breach of contract.
    Acts as counsel to the largest telecommunications company in Korea in an ICC arbitration that involves the determination of ownership of a highly sophisticated and complex telecommunications device. This dispute involves complex domestic regulatory and criminal issues. The national interest of Korea being at stake, also acts as counsel for the client in a currently ongoing international regulatory proceeding related to this arbitration.
    Acts as counsel in a consolidated HKIAC-arbitration arising from a post-M&A dispute regarding the acquisition of shares in a company by a global private equity firm.
    Acts as counsel for a Korean company in a SIAC-arbitration arising from a dispute regarding the engineering, procurement and construction of a heavy rail-based urban transit system in Vietnam.
    Acts as counsel in an HKIAC-arbitration arising from a post-M&A dispute regarding the sale and purchase of shares between a Hong Kong entity and two Korean venture capital investment funds.
    Acts as counsel to a major Korean retail company for the purpose of managing and supervising a US litigation in Guam, USA. The dispute in litigation relates to the award of a contract for exclusive rights to operate duty free stores at the international airport in Guam.
    Acted as counsel to a group of shareholders led by the world’s largest shipbuilding company in a very high-profile ICC arbitration against affiliates of an Abu Dhabi state-owned investment vehicle. The arbitration arose from a dispute among shareholders for control over a major Korean oil refining and marketing company. The underlying claims were valued at over USD 3 billion (USD 5 billion including counterclaims). This successful arbitration was chosen by GAR as the “Win of the Year” for 2011.
    Acted as counsel to Korea’s largest telecommunications research institute in an ICC-arbitration against one of the world’s leading wireless telecommunications companies, arising from a dispute regarding the payment of royalties for wireless telecommunications technology in an amount exceeding USD 500 million.
    Acted as counsel to a Korean construction company in a dispute arising from the engineering and construction of a major mining and processing plant project in Madagascar, Africa. In the final award, the tribunal rejected all liquidated damages claimed against the client and awarded nearly USD 30 million – the entire amount claimed by our client – in respect of outstanding contract payments, plus a substantial amount in reimbursement of the client’s arbitration costs.
    Chairman of the tribunal in a KCAB international arbitration arising from a dispute regarding the payment of commissions under an agency agreement.
    Sole arbitrator in a KCAB international arbitration regarding a dispute over the sale of LED panels and associated equipment.
    Acted as counsel to one of Korea’s largest construction companies in an ICC arbitration arising from the construction of a combined cycle power plant in the Middle East. The tribunal ultimately awarded all of the amounts sought by our client in respect of outstanding contract payments while dismissing the bulk of the counter-party’s claims for liquidated damages.
    Acted as counsel to a major Korean conglomerate in an ICC-arbitration arising from a post-M&A dispute over the purchase of shares in a hypermarkets chain in China. The arbitration concluded with an award in favour of BKL’s client, awarding the full amount claimed by the client.
    Sole arbitrator in a KCAB international arbitration regarding a dispute over the sale and shipment of scrap polymer packaging film.
    Acted as counsel in the second ever ICSID arbitration against the People’s Republic of China, relating to a Korean company’s investment in the construction of a golf country club and condominiums in the Sheyang-Xiam, Jiangsu province.
    Acted as counsel to a major Korean shipbuilder against a major foreign manufacturer of thrusters in an LCIA arbitration seated in London, arising from a dispute regarding alleged defects in certain azimuth thrusters intended to be used in several ultra-deepwater drillships and a semi-submersible rig.
    Acted as counsel in an ICC-arbitration arising from a dispute regarding the transfer and use of technology between a Korean automobile manufacturer and the largest automobile company in the United States.
    Acted as counsel for a Korean private equity company in a dispute against its co-investors, a major Korean media company and related shareholders, arising from the prospective sale of shares in a major multiplex facility in Korea pursuant to the provisions of a complex shareholders’ agreement.
    Sole arbitrator in a KCAB international arbitration arising from a dispute regarding the sale, shipment and installation of a production system for printed circuit boards in Vietnam.
    Sole arbitrator in a KCAB international arbitration arising from a contract regarding the sale of medical equipment between a Dutch and a Korean company.
