Energy and Natural Resources

Bae, Kim & Lee LLC has long been a leader in the energy practice, serving many of the foremost names in power, gas and oil in Korea.

Our energy group has advised KEPCO (Korea Electric Power Corporation) throughout an extensive restructuring and privatization process. We have also handled a great many operational matters for KEPCO, including construction and financing for nuclear and thermal power plants in Korea, as well as in China, India and the Philippines. KOGAS (Korea Gas Corporation) too has relied on BKL for many years of advice in the course of its own restructuring program, and on a wide variety of procurement, supply and investment agreements, including investments in several overseas LNG projects.

We have advised producers and investors in a host of deals in the energy sector—often involving transactional and regulatory complexities that were successfully overcome. For GS Caltex, the second-largest oil refiner in Korea, BKL advised in the sale of two combined heat and power generation plants, a landmark deal of its kind in Korea. We advised SK Group in setting up one of the largest holdings companies in the city gas sector in Korea. We have also handled major transactions involving Mirant Yulchon, LG Power, Hyundai Oilbank and Hyundai Energy, to name a few examples.

We have assisted a number of domestic and overseas clients with a variety of energy sector projects, such as solar and wind power generation in Korea, plant construction in South America, and uranium enrichment contracts for a supplier in the nuclear energy industry in the U.S. Taking advantage of BKL’s expertise in all related areas of regulation in Korea, we have advised clients in connection with a variety of issues—frequently confronting suppliers in Korea—involving trading practices and environmental restrictions.

In addition to regulatory compliance, BKL’s energy practice draws together the Firm’s expertise in project finance, mergers and acquisitions, construction and technology. With in-depth know-how on the transactional aspects of energy in Korea, BKL is able to guide clients through the full spectrum of legal issues in Korea that can affect an energy project, as well as ongoing operation.
