One of the most important resources of a company are its human resources. In Korea, employment regulations are designed to protect this resource – the employer’s workers. One of the features that distinguish Korea’s employment regulations from those of other countries is that employment in Korea is not “at-will” and an employer is not free to break an employment relationship without “justifiable cause.” For over twenty years, BKL’s employment and labor practice group has been assisting clients navigate Korea’s complex employment laws and effectively managing their workforce.

Our team provides a complete range of employment counseling and litigation services to a broad base of clients in domestic as well as foreign markets. Our group’s areas of expertise include employee compensation and benefits, dismissal, sexual harassment or discrimination, plant closings, downsizings, workforce restructuring, non-competition and trade secrets, employment related torts and worker’s compensation and other employment-related issues. Our employment lawyers are regularly retained for advice on labor disputes, collective bargaining agreements, labor union and labor-management council issues as well as employment issues arising out of mergers and acquisitions.

Major Cases

    • Advised Chohung Bank on a large-scale employee downsizing and obtained favorable results on various court challenges to the validity of the lay-offs, including a favorable ruling before the Korean Supreme Court

    • Obtained favorable results for the U. S. in several wrongful dismissal cases involving employees of the U.S. Forces in Korea

    • Obtained a favorable ruling for Kia Motors in a case where the validity of a general wage reduction was challenged

    • Obtained a favorable ruling for KT in a case where the validity of an amendment to work rules allowing KT to impose more severe sanctions against poor performers was challenged

    • Obtained favorable results for Samsung Securities in a case where a former employee claimed unpaid severance payment

    • Advised KEPCO on the transfer of employees in a spin-off of five large power generating businesses and counseled KEPCO on a variety of issues regarding labor strikes

    • Advised Chohung Bank regarding a labor strike arising from Shinhan Bank’s acquisition of Chohung Bank
